MINUTES OF THE PLANNING AND ZONING COMMISSION
July 16, 2015

 

Pursuant to due call and notice thereof, a regular meeting of the Planning and Zoning Commission of the City of Saint Peter was conducted in the Governors' Room of the Community Center on July 16, 2015.  A quorum present, Chairperson Jerry Harty called the meeting to order at 5:31 p.m.  The following members were present:  Commissioners Harty, Joe Urban, Joey Hulsebus, John Kvamme, Andy Davis, Eli Hoehn and Chuck Zieman.  The following official was present: Community Development Director Wille, Administrative Secretary Cindy Moulton and Director of Public Works Pete Moulton. 

Approval of Agenda – A motion was made by Kvamme, seconded by Hulsebus, to approve the agenda with “Public Hearing” added.  With all in favor, the motion carried as amended. 

Approval of Minutes  - A motion was made by Davis, seconded by Zieman to approve the minutes of the June 18, 2015 regular Planning and Zoning Commission meeting.  With all members in favor the minutes were approved as presented.

Public Hearing
Wille presented the background of the proposed school site and athletic fields which would be owned by the school and recreational facilities owned by the City.  Wille indicated that the Planning and Zoning Commission recommended to the City Council to annex the two parcels of land, one parcel owned by the City and the other owned by the School District.  Wille stated that the State Office of Administrative Hearings will review the annexation and that the plats cannot be recorded until they are acknowledged by the State. 

Wille stated that today’s meeting the Commission will consider approving the preliminary and final plats.  He noted that the final site plan is being prepared by the School and City.

The property owned by ISD #508 contains 60 acres and the City side contains approximately 70 acres.  Wille noted that approximately 11 acres of the City owned land lies south of County Road #5 (Fort Road) and abuts land owned by Gustavus Adolphus College.  A single plat has been jointly filed by the two entities. 

Wille said that in order to keep the process moving forward, it is suggested that the land north of County Road #5 be platted as a single lot and block.  The 11 acres south of County Road #5 would be proposed to be platted as an “Outlot”.

The Preliminary Plat identifies a designated wetland lying towards the northernmost portion of the plat.  He stated the wetlands are fed by a drainage structure running along the western and northern boundary of the plat.  The drainage is located within an existing drainage easement.

Wille said the Final Plat identifies Lot 1, Block 1, Magner Farm Subdivision north of County Road #5 and “Outlot A” lying south of County Road #5.  Wille noted that other than the drainage easements depicted on the Preliminary Plat, the Final Plat is devoid of easements or other encumbrances.

The City and School District #508 have be jointly working to prepare a final site plan.  Wille said once the final site plan has been  completed the City and ISD # 508 will jointly file for the Conditional Use Permit necessary to undertake development of the new high school and athletic facilities.

Secondary Educational Facility (High School) is listed as a Conditional use in an R-3 district.  The Board of Zoning Appeals and Adjustments will review the site plan based upon the seventeen standards identified in the Zoning Ordinance.  Give the scale of the development, it is likely that the permit would be conditionally approved.

Once the final approvals have been provided for the site, the City and ISD #508 will seek an Administrative Lot Split to sever the parcel into two separate lots.

Wille said there will be a public hearing regarding the Conditional Use Permit will be held before the Board of Zoning Appeals & Adjustments on September 10, 2015.  The site plan will be reviewed at that meeting.  He stated that anyone that any neighboring property owner that received a notice for this public hearing will receive a mailed notice of the Board of Zoning Appeals & Adjustments public hearing.

Wille said that he met with Oshawa Township regarding the planned improvements to Gardner Road and the future distribution tax proceeds generated from the annexed properties.  At that meeting, the Oshawa Township Supervisors noted that it is their expectation that Oshawa Township will bear no additional financial burden related to the maintenance, repair or plowing of the Township Road following development of the School.  It is their expectation that the City and School will meet with them to discuss the access, maintenance, repair and plowing of the 361st Avenue (Township Road).

Public Hearing
Harty opened the public hearing at 5:46 pm. 

Lee Hertling, 2089 Pratt Circle said that there was a dam put in to keep water from coming into the pond.  Wille indicated that he was unaware of the dam.

Tom Hager, 3994 County Road 15 noted that the dam that Mr. Hertling referred to is outside of the land subject to the plat. He suggested that the City and Council cooperate to ensure that the dam continues to operate properly.

Don Fosburgh, 2055 Pratt Circle was concerned about the tree line and windbreak behind their homes.  Wille said the trees are located on the school / city site.  Wille noted that some method of screening the neighborhood from the institutional use would be appropriate.  It will be determined whether the existing tree line would be maintained or a more effective/attractive method of screenage implemented. 

The public hearing closed at 5:58 pm.

Magner Farm Subdivision (Preliminary Plat)

A motion was made by Hulsebus, seconded by Urban to introduce Resolution No. 2015 – 06 entitled, “Resolution Recommending the Approval of The Preliminary Plat of Magner Farm Subdivision”.  All members voting aye, the Resolution was passed and adopted.

Magner Farm Subdivision (Final Plat)

Hulsebus asked if Outlot A was developable.  Wille replied that the parcel is undevelopable until it is platted, therefore it gives some flexibility as to the future use of the property. 

A motion was made by Davis, seconded by Hoehn to introduce Resolution No. 2015-07 entitled, “Resolution Recommending the Approval of The Final Plat of Magner Farm Subdivision”. Member Kvamme amended the draft resolution to clean up some typographical or syntax errors.  All members voting aye, the Resolution was passed and adopted with Kvamme’s language corrections noted.

There being no further business, a motion was made by Hulsebus seconded by Urban, to adjourn.  With all in favor, the motion carried and the meeting adjourned at 6:05 p.m.
